1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of the East Bay Vivarium website located at eastbayvivarium.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you disagree, please do not use the Site.
2. Nature of the Site
The Site is provided for informational purposes: store hours and location, care information, event listings and related content. The Site itself does not process purchases or payments. Most in-store purchases, exchanges and returns are handled at our physical location and are governed by our in-store policies, not by these Terms. For certain bookings, such as the Traveling Reptile Show, we may send you a prepayment link through Lightspeed, our point-of-sale and payments provider, by text or email. These payments are processed by Lightspeed, not through the Site, and are subject to the booking and cancellation terms below. Any third-party listings referenced from the Site (for example, MorphMarket) are operated by third parties. We are not responsible for the content, accuracy or transactions on third-party platforms, and your use of them is governed by their own terms.
3. Event Bookings and Cancellation Policy
Bookings for the Traveling Reptile Show (or similar events) require prepayment via a Lightspeed payment link.
• Rescheduling a booked show is free, at any time, for any reason.
• Cancelling a booked show more than 72 hours before its scheduled start time incurs no fee.
• Cancelling a booked show within 72 hours of its scheduled start time incurs a $50 cancellation fee.
If you need to reschedule or cancel a booking, contact us using the information in Section 13 below.
4. Care Sheets and Husbandry Information
Care sheets, husbandry guides and similar content on the Site are provided for general informational purposes only. They are not a substitute for professional veterinary advice, and we make no guarantee that following this information will produce any particular outcome for any animal. Always consult a qualified veterinarian, particularly an exotics-experienced vet, for medical concerns.
5. Regulated and Restricted Species
Certain species are restricted or regulated under California law and may not be legally kept, sold or transported without proper authorization. Information on the Site about restricted species is provided as a general reference only and is not legal advice. Laws vary and change; you are solely responsible for confirming the legality of owning any species in your jurisdiction. Questions about the legality of a specific animal should be directed to the California Department of Fish and Wildlife.
6. Intellectual Property
All content on the Site, including text, images, logos and graphics, is owned by East Bay Vivarium or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works from Site content without our prior written permission, except for personal, non-commercial reference.
7. Acceptable Use
You agree not to:
• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to the Site or its underlying systems
• Interfere with the Site's operation or security
• Scrape, harvest or collect data from the Site through automated means without permission
8. Text and Email Communications
If you opt in to receive text messages or email updates from East Bay Vivarium, that communication is governed by the consent you provide at sign-up and by our Privacy Policy. Our text messaging program is operated through SlickText. You may opt out at any time using the instructions provided in those messages.
9. Disclaimer of Warranties
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, availability or fitness for a particular purpose.
10. Limitation of Liability
To the fullest extent permitted by law, East Bay Vivarium is not liable for any indirect, incidental or consequential damages arising from your use of the Site or reliance on its content.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
